Heard learned counsel for the applicant and learned A.G.A. for the State.
The present anticipatory bail application has been filed by the applicant- Ajay Pratap Singh in Case Crime No. 711 of 2019, under Sections 147, 419, 420, 406 I.P.C., Police Station- Naini, District- Prayagraj with the prayer to grant anticipatory bail to him.
I have perused the averments made in the first information report, the order by means of which the anticipatory bail application has been rejected by the court below as well as the material placed on record.
Learned A.G.A. has opposed the prayer for anticipatory bail.
After hearing learned counsel for the parties and considering the fact that the applicant was the coordinator of NGO Kashiram Educational Trust, Lucknow in which a huge security amount was taken from different persons for appointment of teachers, however, as per the record amount of Rs.33,00,000/- has been collected and the same has been misappropriated by the applicant and other co-accused and also looking to the seriousness of the allegation as made in the FIR, gravity of offence and the severity of punishment and the facts as advanced by the learned A.G.A. and also that the applicant may be required for custodial interrogation, no case for grant of any indulgence is made out.
Accordingly, the application for anticipatory bail is rejected.
