The case o the petitioner is that the respondents invited tenders for providing man power to various Community Health Centre under the Director, Medical and Health Services, Uttar Pradesh for District Basti. The petitioner's quotation though was lowest but without assigning any reason his tender has been cancelled and the contract has been given to someone who even not applied under the aforesaid tender notice.
It is submitted by learned counsel appearing on behalf of the petitioner that the subsequent tender awarded too has been cancelled and as such the prayer no.1 has become infructuous.
The argument advanced by learned counsel appearing on behalf of the petitioner is that as a consequence to the cancellation of subsequent tender, the petitioner is entitled to have the contractual work upto 31st March, 2019.
From perusal of the documents annexed with the petition for writ, it is apparent that a principle decision has already been taken by the respondents to avail man power through its own sources and as such the government is not at all interested in availing man power through the private contractors.
In view of it, we do not find any just reason to interfere in the matter. The writ petition hence is dismissed. The petitioner if is having any grievance pertaining to loss said to be caused to him, he may avail appropriate remedy to have the damages.
