Heard learned counsel for the petitioners and learned standing counsel for State- respondents.
Present petition has been filed with following relief;
"Issue a writ order or direction in the nature of mandamus commanding the respondent nos. 2 to consider the promotion of clerks posted at District Cadre in Home Guards Department to the posts to be filled through promotion at Head Quarter/ Division/ Central Training Institute Cadre of Home Guards Department by implementing the Government Order dated 17.04.2014 and Circular Dated 21.07.2015 treating them at par with at Head Quarter/ Divisional Cadre."
Learned counsel for the petitioner submits that for redressal of grievance, they have moved representation dated 6.3.2021, but till date, the same has not been decided. He next submitted that a suitable direction may be issued to respondent no. 2 to consider the representation of the petitioners dated 6.3.2021 and decide the same within stipulated time to which learned Standing Counsel has no objection.
Under such facts and circumstances, this petition is disposed of with direction to respondent no. 2 to consider the representation of the petitioners dated 6.3.2021 and decide the same strictly in accordance with law maximum within a period of two months from the date of production of computer generated copy of the order. Petitioner is also given liberty to annex photocopy of representation dated 6.3.2021 along with computer generated copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no.2 to decide the representation of the petitioner after considering the Act, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
