Notice to engage another counsel was issued to the sole revisionist Ajay Pratap Mall vide order dated 28.07.2021. The office report dated 11.08.2021, shows that the NEC issued to the sole revisionist fixing 12.08.2021, has not returned after service. No one has put in appearance on behalf of the Revisionist. The tracking report obtained from the online portal of India Post indicates that on 06.08.2021, the postal cover was returned with the remark "Item returned. Addressee left without instructions." The postal track has been attached, which this Court has perused. It is evident that the revisionist has lost interest in pursuing this Revision and in any case, appears to be grossly negligent.
This Revision is, therefore, dismissed for non- prosecution.
Interim order, if any, stands vacated.
Let this order be communicated to the Civil Judge (Senior Division), Gorakhpur through the District Judge, Gorakhpur by the Registrar (Compliance) within 24 hours.
