Heard learned counsel for the applicant.
The petitioner is the appellant in the appeal and has come up before this Court claiming following relief as substantial relief:
"Direct the court of Additional District Judge-1st, Basti to decide the Misc. Civil Appeal No. 3 of 2019 (Ajay Prakash Tripathi and another Vs. Ram Bihari), pending before him expeditiously preferably within two months."
It is argued that the delay is being unnecessarily caused and therefore, appeal may be expedited.
Having heard learned counsel for the petitioner, I find that the appeal is of the year 2019 and it is a widely known fact that the State Uttar Pradesh was badly hit initially by the lockdown during the first wave of pandemic Covid-19 and so also subsequently during the 2nd wave of Covid-19 adversely affecting the judicial functions of the courts in the State.
In such above view of the matter, therefore, this Court does not find it feasible to expedite the appeal of the year 2019. However, it is expected that the court concerned shall expeditiously, preferably within a period of three months, dispose of the appeal in accordance with law.
The petition is disposed of with the aforesaid observations and directions.
