Heard learned counsel for the petitioners, learned AGA for the State-respondents and perused the records.
By means of present writ petition, the petitioners are seeking quashing of FIR dated 04.04.2021, registered as Case Crime No. 0087 of 2021, under Sections 504, 506 IPC and Section 3 (1) (Dha) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amendment Act, 2015), Police Station Badalpur, District Madhya Commissionrate, Gautam Budh Nagar.
The complainant is Assistant Teacher in an Institution, wherein the petitioner no. 1 is also working as official. Petitioner no. 2 is Principal of the Institution concerned.
Submission of learned counsel for the petitioners is that the complainant is indisciplined worker and she has made false allegations in order to harass the petitioners. The allegations made in the FIR are false and baseless.
Considering the submission made by the learned counsel for the petitioners and the material on record, though we do not find any reason to quash the First Information Report but for the assertions made herein, it is provided that the petitioners shall not be arrested pursuant to the aforesaid First Information Report, till submission of the police report under Section 173(2) Cr.P.C. They shall, however, cooperate in the investigation and shall not make any effort to influence any witnesses or tamper any evidence.
The writ petition is, accordingly, disposed of.
