The present application under Section 482 Cr.P.C. has been filed for quashing the NBW dated 26.02.2020 to 16.09.2021 passed by Additional Sessions Judge/Special Judge, Gangster Act, Court No.05, Fatehpur as well as further proceeding of S.T. No. 240 of 2019,arising out of case crime no. 313 of 2017 under Section 419, 420, 406, 506 IPC, P.S. Kotwali, District Fatehpur pending in the court of Additional Sessions Judge/Special Judge, Gangster Act, Court No.05, Fatehpur.
Since the applicant has already invoked all the proceeding available to him but he has not surrendered before the court concerned and now NBW has been issued against the applicant. I am not inclined to exercise the power under Section 482 Cr.P.C. in favour of the applicant.
Accordingly, the application u/s 482 Cr.P.C. is hereby rejected.
