The prayer made in the instant petition is for issuing direction to the court below to decide the application for temporary injunction pending in Original Suit No.138 of 2019 expeditiously and direct respondent No.2 not to make any construction over the suit land during pendency of the suit.
It is not in dispute that the trial court did not grant exparte injunction but invited objection from the defendant postponing the disposal of the application for temporary injunction.
It is not clear from the order sheet whether the defendant has been served in the matter or not.
The instant petition is disposed of by providing that the trial court shall decide the application for temporary injunction expeditiously soon after the defendant is duly served.
