The petitioner claims that he passed IInd, IIIrd and IVth semester of BTC training course 2013, but failed in two papers of the Ist semester. His aggregate marks in the Ist semester is more than 50%. It is urged that in such circumstances, the petitioner is entitled to 10 grace marks. In support of the said contention, learned counsel for the petitioner has placed reliance on Examination Rules annexed at page 40A of the writ petition.
Learned standing counsel states that the matter would be examined by respondent No. 4, Secretary, Examination Regulatory Authority, U.P. Allahabad.
Accordingly, the instant writ petition is disposed of with liberty to the petitioner to approach the fourth respondent with a certified copy of this order along with a fresh representation. In the event, any such representation is made, the same shall be decided by the fourth respondent, by means of a speaking order, in accordance with law, expeditiously and preferably within a period of next eight weeks.
