Heard Sri Atul Dayal, learned counsel for the revisionist and Sri Pradeep Kumar holding brief of Sri Shri Krishna Yadav, learned counsel appearing for the respondents.
The present revision has been filed challenging the order dated 21.10.2014 passed by the Small Causes Court (Additional District Judge, Court No.2), Jaunpur in SCC Suit No.07 of 2008 (Vivek Seth and others vs. Ajai Kumar and others) by which the application under Section 23 of the Provincial Small Causes Court Act has been rejected.
After some arguments both the parties agree that the matter may be remanded back to the trial court for decision afresh on an application filed by the revisionist herein under Section 23 of the Provisional Small Cause Court, 1887.
Accordingly, in view of the aforesaid, as agreed between the parties, the impugned order is set aside and the matter is remanded back to the trial court for decision afresh on an application filed by the revisionist herein under Section 23 of the aforesaid Act preferably within a period of two months.
The revision stands disposed of.
Both the parties agree that they will not seek any adjournment in case the aforesaid application is decided expeditiously.
Since the revision stands disposed of, the interim order operating in this case also stands vacated.
