This case has been taken up through video conferencing. It is accompanied with an application for urgency. On due consideration, the application is allowed.
Notice on behalf of opposite party Nos.1, 3 and 4 has been accepted by the learned Chief Standing Counsel, whereas Sri Akash Singh, Advocate appears for opposite party No.2.
The P.I.L. has been filed seeking following reliefs:-
"(i) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite parties to amend the reservation of seat of the Gram Panchayat Harnahwasusta, Block-Gansadi, District Balrampur.
(ii) Issue a writ, order or direction in the nature of mandamus thereby commanding and directing the opposite party no.3 to consider and take decision in pursuance of the application dated 23.03.2021, moved by the petitioner and other villagers, contained as Annexure No.3 to this writ petition.
(iii) Issue any other order or direction deemed just and equitable under the circumstances of the case in favour of the petitioner.
(iv) Allow the writ petition with costs."
Learned Counsel for opposite parties submit that the notification for holding Panchayat Election has been issued vide notification dated 26.3.2021. Moreover, in view of the constitutional bar under Article 243 (O) of the Constitution of India, the writ petition at this stage is not maintainable.
We agree with the objection raised by learned counsel for the opposite parties.
The P.I.L. is accordingly dismissed being not maintainable.
