Heard Sri Praval Tripathi, learned counsel for the petitioner, Sri M.K. Yadav, learned counsel for the respondent no.4 and Sri Dhirendra Singh, brief holder for the respondents no. 1 to 3.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment over Gata no. 171 area 0.142 hectare, Gata no. 170 area 0.011 hectare and Gata no. 173 area 0.016 hectare which according to him is water body. It is further stated that the Tehsildar submitted a report on 19.12.2017, Annexure-4 to the writ petition confirming that some persons have illegally encroached on the land in question as they have no house to live in. It appears that the Tehsildar is acting in collusion with the encroachers.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no.3-Tehsildar, Tehsil Sadar, District Jaunpur to enquire into the matter and take appropriate action, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that that court has not adjudicated the claim of the petitioner on merit.
