The present appeal has been filed against the judgment and order dated 31.08.2010 passed by Additional Sessions Judge, Court No. 16, Kanpur Nagar in Sessions Trial No. 48 of 2008 ( State Vs. Ajay Kumar and others) arising out of Case Crime No. 250 of 2008 under Sections 498 A, 304 B,323/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act relating to Police Station Chamanganj, District Kanpur Nagar, whereby the appellant had been convicted and sentenced as under:-
(i) Under section 304 B I.P.C. - Rigorous Imprisonment for a period of seven years.
(ii) Under section 498 A I.P.C. - Rigorous Imprisonment for a period of three years alongwith fine of Rs.500/- with default stipulation.
(iii) Under Section 4 of Dowry Prohibition Act-Rigorous Imprisonment for a period of one year along with fine of Rs. 1,000/- with default stipulation.
Vide order dated 21.02.2018, Jail Superintended, Kanpur Nagar was directed to seek instructions as to whether the appellant is still in jail.
In pursuance to the order dated 21.02.2018, a report of Jail Superintendent, Kanpur Nagar is received to this Court and the same is taken on record. From perusal of the same, it is evident that appellant-Ajay Kumar has been released from Jail on 07.09.2013 after undergoing the stipulated sentence and payment of fine awarded to him.
In view of the above, the present appeal has lost its efficacy.
Dismissed accordingly.
Having considered the facts and circumstances of the case and gone through the judgment passed by the court below, the judgement of conviction and order of sentence passed against the appellant is confirmed.
