Heard Shri Anil Kumar Srivastava,learned Senior Counsel assisted by Shri Prem Narayan Singh and Shri Ram Bahadur, learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Ajay Kumar, in Case Crime No. 892 of 2020, under Sections- 147,323,504,506,354 I.P.C., Police Station- Cantt, District- Varanasi.
There is allegation against fourteen named accused persons in the First Information Report that they were involved in gambling before the house of the informant. When daughter of the informant protested they threatened her and abused her and also tried to outrage her modesty. Learned counsel for the applicant has submitted that he has been falsely implicated in this case on account of village politics.No medical examination of the injured was conducted.
The applicant has already been enlarged on interim anticipatory bail by this Court by order dated 08.02.2021.
The order is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 08.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
