Heard learned counsel for the petitioner and Shri Sanjai Kumar Singh, learned counsel for the fourth respondent.
The petitioner is before this Court with request to issue direction to the respondents to fill up three vacant posts of Assistant Teacher in District Mirzapur reserved for Scheduled Tribe category candidates by the candidates belonging to Scheduled Caste category.
Record in question reflects that the State Govt. issued a G.O. dated 16.6.2016 notifying recruitment for filling up 16448 posts of Assistant Teachers in Primary Schools run and managed by the Basic Shiksha Parishad, U.P. Allahabad. The petitioner belongs to Scheduled Caste category. He made an application and was called for counselling. He was declared unsuccessful. Later, it was found that a large number of vacancies under Scheduled Tribes category are still lying vacant. Some of the candidates preferred a writ petition in this Court at Lucknow Bench being Writ Petition No. 4812 of 2017 wherein an interim order was passed on 10.3.2017 till 21.3.2017. It is stated that the said interim order was not extended.
At the very outset, learned counsel for the petitioner apprises to the Court that in similar circumstances, this Court had disposed of Writ A No. 52705 of 2017 (Ramesh Kumar vs. State of UP and three others) on 28.11.2017 and Writ A No.61611 of 2017 (Umesh Chandra vs. State of UP and 3 ors) on 20.12.2017 asking the District Basic Education Officer of the concerned district to conduct counselling of the petitioners by fixing a fresh date to fill up the vacancies of Scheduled Tribe category by the candidates belonging to Scheduled Caste expeditiously preferably within two months from the date of communication of this order.
Following the orders of this Court in Ramesh Kumar's case and Umesh Chandra's case, this writ petition is also disposed of asking the fourth respondent- Zila Basic Shiksha Adhikari, Mirzapur to conduct counselling by fixing a fresh date to fill up the vacancies of Scheduled Tribe category by the candidates belonging to Scheduled Caste, expeditiously preferably within two months from the date of communication of the order.
