Heard Sri G. S. Chaturvedi, learned Senior Counsel, assisted by Sri Alok Ranjan Mishra, learned counsel for the petitioners, Sri Shambhavi Nandan, learned counsel for the complainant and Sri Yogeshwar Rai, learned AGA appearing for the State.
The contention of the counsel for the petitioners is that the dispute is essentially is of the civil nature pertaining to transfer of share.
The counsel for the complainant seeks time to file a counter affidavit and bringing on record some documents to show that some fraud has been committed by the petitioners in the matter.
In view of the aforesaid, a case for grant of indulgence has been made out. Learned AGA appear for the respondent nos. 1, 2 and 3.
Issue notice to respondent no.4. Steps be taken within a week.
All the respondents are granted four weeks time to file a counter affidavit. The counsel for the petitioners is granted three weeks time therefore to file a rejoinder affidavit.
List immediately thereafter.
Till the next date of listing no coercive action shall be taken against the petitioners in pursuance of the impugned FIR dated 19.04.2019, registered as Case Crime No.333 of 2019, under Sections 420, 406, 467, 468, 471, 120-B, 504, 506, IPC, Police Station Kasna, District Gautam Budh Nagar.
