Heard Sri Shrawan Dwivedi, learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent nos.1 to 3.
By means of this writ petition, the petitioner has prayed for quashing of the impugned transfer order dated 27.05.2019 passed by the respondent no.2.
It is contended by learned counsel for the petitioner that the petitioner sought certain information regarding misuse of medical funds and also highlighted the irregularities committed at Primary Health Centre Aamraudha, Kanpur Dehat, and as such, he had been transferred on extraneous consideration.
The impugned order dated 27.5.2019 (Annexure 6 to the writ petition) records that the transfer of the petitioner has been made on administrative ground.
It is also to be noticed that the petitioner was posted at Primary Health Centre Aamraudha, Kanpur Dehat in the year 2010 and he holds a transferable post.
In view of the above, this Court is not inclined to interfere with transfer order in exercise of its discretionary jurisdiction under Article 226 of the Constitution of India.
The petitioner may approach the competent authority by filing a representation, which shall be considered and decided on merits by passing a reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing a certified copy of this Court alongwith copy of writ petition.
The representation of the petitioner shall be considered after the petitioner reports at the transferred place.
The writ petition is, accordingly, disposed off. Order Date :- 12.6.2019 Ajeet
