Heard Shri V.D. Shukla, learned counsel for the petitioner, Shri Pranjal Mehrotra, learned counsel for the respondent no.2 and the learned Standing Counsel for the respondent no.1.
The petitioner is seeking appointment on compassionate ground.
In paragraph 12 of the writ petition it is stated that the father of the petitioner died on 23.10.2017 and thereafter the petitioner applied for appointment on compassionate ground. However, the first and only representation on record, copy of which has been filed as Annexure-4 to the writ petition is dated 02.04.2018.
If the petitioner is seeking appointment on compassionate ground he should give at least enough time to the respondents to find out whether there is suitable vacancy available in the Department and what is the eligibility criteria for such appointment. He cannot assume that the moment he prefers a representation seeking appointment on compassionate ground, the competent authority should leave all other work and take up the petitioner's application and, if not, the petitioner should rush to the Court seeking a direction.
The writ petition is, therefore, premature at this stage and is accordingly dismissed.
