Heard Sri Babu Lal Ram, learned counsel for the applicants and Sri G.P. Singh, learned AGA for the State.
This Criminal Misc. Anticipatory Bail Application under Section 438 Cr.P.C. has been moved by the applicants seeking anticipatory bail in Case Crime No. 191/2021, under Sections 392/323/504/506 IPC, Police Station Dhoomanganj, District Prayagraj, during the pendency of the investigation.
It is contended that the applicant no. 1 was married with the informant in the year 2019, copy of the marriage certificate has been brought on record. It is further contended that as dispute arose between the parties and same has now been compromised and both the applicant no. 1 and informant are living together.
Learned AGA appearing for the State vehemently opposed the bail application and invited attention of the Court to the FIR, which has been lodged by the informant on 24.02.2021 wherein it has been stated by the informant that after the marriage, the applicants forced her to annul the marriage and go to her parents home and the marriage of the applicant no. 1 was fixed with one Sarita in October 2020.
In the light of above, looking to the facts and circumstances of this case, submissions of learned counsel for the parties as mentioned above, taking into consideration the role assigned to the applicants as per prosecution case, gravity and nature of accusation, as well as the allegation made in the FIR, which are serious in nature, this Court is of the view that no case for exercising its discretionary power under Section 438 Cr.P.C. is made out in favour of applicants.
Accordingly, this application under Section 438 Cr.P.C. is rejected.
