Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application under Section 482, Cr.P.C. has been filed by the applicant for quashing the entire proceedings of Criminal Misc. Execution No.F-7 of 2018 (Reksha Vs. Ajay Kumar @ Bablu), under Section 128, Cr.P.C. arising out of the order dated 22.11.2017 in Complaint No.125 of 2016, P.S. Koirauna, District Sant Ravi Das Nagar/Bhadohi (Gyanpur), pending in the court of Principal Judge, Family Court, Bhadohi at Gyanpur.
Submission is that the applicant has filed recall application for recalling the exparte order and also the order passed under Section 128, Cr.P.C. before the Principal Judge, Family Court, Bhadohi at Gyanpur. The same is stated to be pending.
Court below is directed to pass appropriate orders on the aforesaid application within a period of one month from the date of production of certified copy of this order. Til the application is decided, no recovery proceedings shall be initiated against the applicant.
