Heard Shri B.K. Mishra, learned counsel for the petitioner, learned standing counsel for the respondent no. 1 and Shri Ravindra Singh, learned counsel appearing for the respondents no. 2 to 6.
The petitioner in the writ petition is seeking a direction to the respondents to pay the balance amount of the provident fund. The petitioner is stated to have retired from service under the respondents from the post of Treasurer, Cane Co-operative Development Samiti, Pratappur, District Deoria on 28.2.2017.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 2-Cane Commissioner/Chairman, State Cane Service Tribunal, U.P. Lucknow to consider the claim of the petitioner and take a decision in accordance with law within a period of two months from the date of receipt of a certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
