Heard learned counsel for the petitioner.
The present petition has been filed seeking a direction to the Additional Civil Judge (Senior Division) Court No.15, Allahabad to consider and decide the Civil Suit as Suit No. 59 of 2011 (Ajay Kumar Sharma Vs. Shashikant Sharma) expeditiously and preferably within stipulated period.
Bearing in mind the fact that in the suit orders had been passed for it proceed ex parte the defendants and which was subsequently recalled in August 2018 and since presently the suit is at the stage of cross examination of witnesses, this petition is disposed of with a direction to the concerned Additional Civil Judge to move in the matter with expedition and ensure that no unnecessary adjournments are granted to either of the parties. The Civil Judge shall also endeavour to dispose of the suit preferably within a period of six months from the date of presentation of a duly authenticated copy of this order subject to its roster and the pendency of older matters.
