High Court Of Judicature at Allahabad|28 May, 2021

JUDGMENT / ORDER

The present bail application has been filed on behalf of the accused/applicant in Crime No. 87/2021, under Sections 147, 148, 395, 332, 353, 504, 506, 336, 412, 34 IPC, Section 7 Criminal Law Amendment Act and Section 136(2)(b) of the Representation of People Act, 1950, 1951, 1989, Police Station Sangramgarh, District Pratapgarh, with the prayer to enlarge him on bail.
Heard Mr Ravi Shanker Singh, learned counsel for the accused/applicant and Mr. Pankaj Pandey, learned A.G.A. appearing on behalf of the State through Video Conferencing in view of Covid-19 pandemic.
It is submitted by the learned counsel for the accused/applicant that the accused/applicant is innocent and has falsely been implicated in the case. The accused/applicant is not named in the F.I.R. and no recovery has been made from him. The accused/applicant has no criminal history and is languishing in jail since 21.04.2021, as such, the accused/applicant should be enlarged on bail.
Per contra, learned A.G.A. appearing on behalf of the State has opposed the bail application of the accused/applicant and submitted that accused/applicant was present at the spot when the crime was committed by the main accused namely Manoj Vishwakarma. The name of the accused/applicant came into light in the confessional statement of Manoj Vishwakarma, as such, the accused/applicant should not be released on bail.
Considered the rival submissions and perused the record.
Admittedly, the accused/applicant was not named in the F.I.R. and no recovery was made from him. The alleged recovery has been made upon pointing out of the main accused namely Manoj Vishwakarma.
Considering all the facts and circumstances of the case, it appears just to enlarge the accused/applicant on bail.
