Amendment application is allowed. Petitioner is permitted to carry out amendment during course of the day. Ref:- Writ Petition This petition has been filed for a direction upon the respondents to prepare a waiting list. By a subsequent amendment prayer has been made to direct the respondents to select the petitioner for appointment to the post of Village Development Officer on the basis of cut-off marks of the petitioner.
So far as the first prayer made in the writ petition is concerned, this Court in Writ Petition No.16817 of 2018 vide order dated 8.8.2018 has already rejected similar plea, and therefore, the issue need not be examined any further.
The record further reveals that petitioner has scored 65 marks in written test and scored 13 marks in interview and his grand total is 78 marks. The cut-off for unreserved category is otherwise 66 and above marks in written test and 12 marks in interview. It is pointed out that as per the instructions, the candidates having higher marks in written test would be given preference in case two candidates scored identical marks. It is stated that petitioner since has scored 65 marks in written test, whereas the cut-off for the unreserved category is 66 marks, as such petitioner has not been selected.
In the facts and circumstances, noticed above, this Court find that the marks obtained by the petitioner is below the cut-off in the unreserved category, and therefore, no exception can be taken, if petitioner has been denied selection to the post.
Writ petition is, accordingly, dismissed.
