Heard learned counsel for the applicant; Shri Saurabh Kumar, learned counsel for the informant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Ajay Kumar Mishra, in Case Crime No. 761 of 2018, under Sections- 304 I.P.C., Police Station- Rohania Varanasi, District- Varanasi.
The applicant was enlarged on interim anticipatory bail by this Court by order dated 08.01.2020.
Learned A.G.A. was granted time to file reply/instructions within three weeks, but no reply has been filed.
Shri Saurabh Kumar,learned counsel for the informant is present but he has also not filed counter affidavit.
The order dated 8.1.2020 is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 08.01.2020. The investigating officer shall conclude the investigation within a month.
The anticipatory bail application is allowed to the aforementioned extent.
