Heard Sri Sushil Kumar Pal, learned counsel for the petitioner, Sri G.P. Singh, learned A.G.A., Sri Sikandar B. Kochar, learned counsel for the private respondents and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to respondent no.2 and his subordinate officers for ensuring fair investigation of case crime no. 0224 of 2019 under sections 419, 420, 467, 468, 471, 452, 504 and 506 I.P.C., police station Kydganj, District Prayagraj (Allahabad).
Learned counsel for the petitioner submits that the petitioner is innocent and the present FIR has been lodged with a malafide intention for the purposes of harassment, hence the same is liable to be quashed.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
With the above direction this petition is finally disposed of.
