The writ petition arises out of a mutation proceedings.
The mutation courts have passed an order in favour of the opposite party accepting the registered will in his favour. The consequential revision has been dismissed by the Additional Commissioner (Judicial). Hence this writ petition challenging the order of the Tehsildar and the Additional Commissioner.
During the course of arguments, it transpires that a civil suit for cancellation of the registered will on the basis whereof mutation has been ordered in favour of the opposite party is pending consideration.
In the aforesaid factual background, this writ petition is disposed of with the observation that the orders impugned in this writ petition shall necessarily abide by the final decision in the civil suit admittedly pending between the parties.
