The petitioner herein seeks payment of salary w.e.f. August, 2018 for the post of Clerk-cum-Computer Operator in Nagar Panchayat, Rudayan, District-Badaun.
The contention is that the petitioner was appointed on the aforesaid post on 20.01.2014 and he stated to have joined his duty on 15.02.2014 and thereafter, his services were confirmed by respondent no.3 on 07.04.2016. There has been no complaint against him but the salary, attached to the post, has not been paid since after July, 2018, without any order of withholding the same.
It is further contended that there is no valid reason for withholding of salary because the petitioner had worked continuously.
Be that as it may, the dispute being raised by the petitioner requires a factual enquiry. Without expressing any opinion as to the merits of the claim of the petitioner, the writ petition is being disposed of with a direction to competent authority i.e. respondent no.3, namely, the Chairman, Nagar Panchayat, Rudayan, Badaun, to look to the claim of the petitioner and pass appropriate order, in accordance with law, within a period of one month from the date submission of certified copy of this order.
