Heard the learned counsel for the appellants, learned A.G.A. for the State of U.P. and perused the lower court record.
From the perusal of the lower court record it appears that the F.I.R. of this case has been lodged on 28.4.2000 at 6.50 in respect of the incident allegedly occurred after 2.00 p.m. on 27.4.2000. The dead body of the deceased was found inside the house of Sonu. It is alleged that she was put on fire on 28.4.2000, she gave a dying declaration also. The other co-accused Ajai and Naubat escaped from the place of occurrence. According to the post mortem examination report the deceased has sustained burn injuries, at this stage we are not inclined to release the appellant on bail, therefore, the prayer for bail is refused.
However, considering the submission of the learned counsel for the appellants that it is an old matter and the lower court record has been received, we expedite the hearing of the appeal. The office is directed prepare the paper book of this case within six months from today.
List this case for final hearing on 21.8.2012.
