Contention raised at the Bar is that the applicant has been falsely implicated in the present case. It has been further submitted that though the name of the applicant Ajay @ Kallu @ Ajay Singh has been mentioned in the FIR but during investigation his name was dropped by the police and charge sheet under sections 147,148, 149, 302/34 IPC and 27/30 of the Arms Act has been submitted against eleven accused, barring the present applicant. Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties and without expressing any opinion on merits of the case, I am of the view that the applicant has made out a case for bail.
