Heard learned counsel for the petitioners and the learned A.G.A. for the State.
This writ petition has been filed by the petitioners with a prayer for quashing the impugned FIR dated 26.1.2016 bearing case crime no.0039 of 2016, under sections 147, 149, 323, 504, 506 IPC, P.S. Kotwali, district Maharajganj.
The learned counsel for the petitioners submitted that Smt. Kiran Gupta wife of the petitioner no.1 is a candidate in the forthcoming election for the post of Block Pramukh which is scheduled on 7.2.2016. The petitioner nos. 2 and 3 are her supporters. He next submitted that the impugned FIR has been lodged by respondent no. 4. Smt. Gazala Afaq who is also a candidate for the post of Block Pramukh sponsored by ruling Samajwadi Party. The impugned F.I.R. has been lodged by the respondent no.4 with an intention of putting pressure upon the petitioner no.1 to persuade his wife to withdraw her candidature.
The submission made by the learned counsel for the petitioners appear to be correct. The matter requires consideration.
Learned A.G.A. appearing on behalf of respondent nos. 1 to 3 prays for and is granted one week time to seek instructions.
List on 15.2.2016 before the appropriate Bench.
Till the next date of listing, the petitioners shall not be arrested in case crime no.0039 of 2016, under sections 147, 149, 323, 504, 506 IPC, P.S. Kotwali, district Maharajganj.
A copy of the order shall be given to the learned counsel for the parties today on payment of usual charges.
