The prayer made in the instant petition is for issuing direction to the trial court to decide Original Suit No. 934 of 1987 consolidated with Original Suit No. 908 of 1991 within a specified time frame. The petitioners have also prayed for a direction to the first respondent to decide the transfer application filed by them expeditiously.
It is stated that the trial court is lying vacant and consequently, petitioners have filed application for transfer of proceedings to some other court. The transfer application is still pending consideration before the first respondent.
Having regard to the facts of the case, the instant petition is disposed of with direction to the first respondent to pass appropriate order on the transfer application within four weeks from the date of receipt of certified copy of the order. The court before, whom the suits are pending or the transferee court shall make endeavour to conclude the proceedings of the suits expeditiously, by fixing short dates and without granting unnecessary adjournments.
