Heard Mr. Kogje, learned advocate for the petitioners, and Mr. Kodekar, learned APP, for the respondent State.
Mr.
Kogje, learned advocate for the petitioners, has submitted that the original accused no.1 admitted that he had stolen the password of present petitioners and used it for allegedly misappropriating the amount in question. It is also claimed that even according to the bank officials and the complainant, the password was stolen by accused no.1 and the only allegation made against the petitioners is of negligence. In short, it is submitted that any offence under Sections 420, 408, 467, 468, 471, 477(A), 34 and 120(B) of the Indian Penal Code is not made out against the petitioners.
It is also claimed that the petitioners have been granted anticipatory bail by this Court and the petitioners are already suspended and departmental proceedings are in progress.
Having regard to the aforesaid aspects, let notice be issued, returnable on 30.1.2013.
