Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Applicant is not named in the F.I.R. A Mobile Phone and Rs. 1400/- are alleged to be recovered from the possession of the applicant.
The offences are triable by the Magistrate. The applicant is in jail since 01.10.2008.
Considering all the facts and circumstances of the case and without expressing any opinion on the merits of the case, I find it to be a fit case for bail.
Let the applicant Ajay @ Bindar Kori involved in Case Crime No. 298 of 2008, under Sections 394, 411 IPC, pertaining to Police Station Fazalganj, District Kanpur Nagar, be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the Court concerned.
