1. The petition, in effect, seeks issuance of a writ in the nature of mandamus directing proper investigation in Case Crime No.397 of 2015, under Sections 419, 420, 467, 468, 471 I.P.C., Police Station Cantt., District Faizabad and Case Crime No.514 of 2015, under Section 419, 420, 467, 468, 471, 323, 504, 506 I.P.C., Police Station Cantt. District Faizabad.
2. Learned counsel for the State has pointed out that petitioner has filed writ petition Misc. Bench No.1360 of 2016 (Ajai Kumar & others vs. State of U.P. & others) for quashing of Case Crime No.514 of 2015 (supra).
3. We find that in context of Case Crime No.397 of 2015 (supra) also writ petition Misc. Bench No.10667 of 2015 (Ajai Kumar & another vs. State of U.P. & others) was filed. In the said case charge-sheet has already been filed.
4. It is most unfortunate that order (Annexure-9) has been appended in context of Case Crime No.397 of 2015. The final order passed by the Court has not been appended.
5. Considering the fact that writ petitions for quashing of both the case crime numbers in context of which prayer has been made have been dismissed while dealing with a writ in the nature of certiorari, no ground for indulgence is made out.
6. The petition is dismissed.
7. Let a copy of this order be placed on record of the file of writ petition Misc. Bench No.1360 of 2016.
