JUDGMENT / ORDER

Heard the learned counsel for the petitioner and learned A.G.A. who has put in appearance on behalf of State of U.P., opposite parties nos.1 and 2.
Issue notice to opposite party no.3 returnable at an early date.
Steps may be taken within seven days by registered post failing which the interim order which is being passed hereinbelow shall come to an end automatically.
List immediately after service.
Learned counsel for the petitioners points out that on the basis of mutual consent a divorce has been granted on 22.07.2004 vide Annexure-6. After a gap of about 3 years this F.I.R. has been lodged under Sections 498-A, 323, 504 I.P.C. and Section 3/4 D.P. Act.
There appears some substance in the aforesaid submissions.
In view of the above as an interim measure it is provided that till the next date of listing the proceedings arising out of Case Crime No. 722 of 2007, under Sections 323, 504, 498-A I.P.C. and Section 3/4 D.P. Act, Police Station Kotwali Nagar, District Balrampur so far it relates to the petitioners shall remain stayed.
