Heard learned counsel for the petitioners.
The record indicates that the suit instituted in 1987 was decreed on 17 September 2011 on the basis of a purported compromise entered into between the parties. The respondents herein thereafter moved an application for recall of that ex-parte decree alleging that the compromise was based on forged and fabricated material and that it had no consent. That application moved in 2012 is stated to be pending before the concerned trial Judge.
Bearing in mind the fact that the case itself relates to a suit which was instituted as far as back in 1987, the ends of justice would merit the petition being disposed of with a direction to the Civil Judge (Junior Division) Basti before whom recall application dated 11 May 2012 is stated to be pending to dispose of the said application expeditiously and preferably within a period of six months from the date of presentation of a certified copy of this order.
