Heard Sri S.K. Mishra, learned counsel for the applicant, Sri A.R. Chaurasia, learned A.G.A. for the State and perused the record.
The present application has been moved on behalf of the applicant with a prayer to recall the order dated 9.5.2013 by which the petition was dismissed on the ground that the applicant has not complied with the order of this Court dated 29.5.2012 by which he was required to deposit Rs. 10,000/- in the Mediation Centre of this Court.
It is submitted by learned counsel for the applicant that the applicant has deposited the said amount but no receipt has been annexed with the present recall application though averment has been mentioned in para-5 of the accompanying affidavit.
The present recall application is rejected on this ground alone with liberty to file fresh annexing the receipt of the amount so deposited in the Mediation Centre by the applicant.
