JUDGMENT / ORDER

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing on behalf of the respondents.
2.By consent of the parties, this Writ petition is taken up for final hearing and disposal.
3. This petition has been filed seeking for a writ of Mandamus to direct the second respondent to dispose of the appeal presented by the petitioner by its letter No.27, dated 14.05.2009, at the earliest point of time, as may be fixed by this Court.
4. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the second respondent is directed to dispose of the appeal presented by the petitioner, by letter No.27, dated 14.05.2009, to the second respondent,on merits and in accordance with law, after giving an opportunity of hearing to the petitioner to put forth his case, within a specified time.
5. The learned Government Advocate appearing on behalf of the respondents has no objection, for such an order being passed by this Court.
6. In view of the submissions made by the learned counsels appearing on either side, the second respondent is directed to dispose of the appeal presented by the petitioner, by letter No.27, dated 14.05.2009, on merits and in accordance with law, after giving an opportunity of hearing to the petitioner,within a period of 4 weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish a copy of the appeal, dated 14.05.2009 , to the second respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter. The writ petition is disposed of accordingly. No costs.
