Heard Sri Girish Tiwari, learned counsel for the petitioners and Sri Abhishek Shukla, the learned Standing Counsel.
This writ petition is directed against the order dated 30.11.2017 passed by Commissioner, Moradabad in Revision No.C20173001538 of 2017-18 (Burhan Ahmad Vs. Aisha and others) allowing the restoration application and directing the Tehsildar, Rampur to decide the proceedings under Section 34 of Land Revenue Act afresh after hearing the parties concerned.
Having heard the respective counsels' of the parties concerned, the court does not find any good ground against the order of remand.
The writ petition is dismissed but with a observation that subject to the cooperation of the parties, the pending proceedings before the Tehsildar shall be decided expeditiously.
Learned counsel for the petitioner undertakes that he shall not seek any adjournment and so also is expected from the private opposite parties in the mutation case, except for strong and compelling reasons, else would attract an exemplary cost of not less than Rs.250/- payable to the other side.
It is clarified that the proceedings as far as possible should not be repeatedly adjourned, merely on the ground that the Presiding Officer is busy in administrative work.
