The petitioner contends that against the order dated 15.03.2018 passed under Section 67 of the U.P. Revenue Code, 2006 for the demolition of the illegal encroachments made by the respondent no. 5 a Revision had been filed. There is no interim order in the Revision. The petitioner submits that when there was no interim order granted by the Appellate Court staying the orders of eviction then the respondent nos. 4 and 5 should be evicted.
The Court, however, feels that when the Revision was pending and the order of demolition/ eviction was being adjudicated upon then the order passed under Section 67 of the U.P. Revenue Code, 2006 should not be executed.
However, it is, directed that the Revision itself be decided within a period of one month from the date of presentation of a certified copy of this order, if there is no other legal impediment.
The writ petition is disposed of.
