Heard Sri Umesh Kumar Singh, learned counsel for the petitioner, Sri Rahul Malviya, learned Standing Counsel appearing for the State respondents no.1,2 & 3 and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has prayed for the payment of adequate compensation for the simple reason that the land falling over the plot No.701/4Ka which is recorded in the name of the petitioner in the relevant revenue records has come to be utilized for the purposes of road and accordingly he submits that without proper acquisition proceedings the the road could not have been taken from her agricultural field and that too without giving adequate compensation for the same.
In such view of the matter and as from the perusal of the Khatauni it is clear that the petitioner is a recorded over the plot No.701/4Ka and has made an application to the District Magistrate concerned, we are directing the District Magistrate concerned to dispose of the pending application of the petitioner dated 16.11.2019 after putting to notice for respondent no.4 who is making construction of the road over the plot in question.
We further direct that the concerned District Magistrate shall dispose of the pending application of the petitioner as expeditiously as possible within a period of eight months from the date of production of a certified copy of this order.
With the aforesaid observations and directions, the writ petition stands disposed of.
