HONOURABLE MR.JUSTICE JAYANT PATEL) The learned counsel Ms.Jhaveri for the appellant as well as Mr.Mehta for the respondent submit that the issue involved in the present appeal is covered by the decision of this Court dated 28.06.2012 in First Appeal No. 382/03, except there is change in the assessment inasmuch as in the present appeal, the assessment year is 1997-1998.

Under the circumstances, in view of the reasons recorded in the above referred decision, the present appeal also deserves to be dismissed. Hence, dismissed. No order as to costs.
