1. Present application, under section 378(4) of the Code of Criminal Procedure, 1973 has been preferred by the applicant Ahmedabad Municipal Corporation for Leave to Appeal against the impugned judgment and order of acquittal dated 31.5.2012 passed by the learned Addl. Sessions Judge, Court No.6, City Sessions Court Ahmedabad in Criminal Appeal No.36 of 2012 acquitting the opponent herein original accused for the offence punishable under Section 7(i) and Section 16(1)(a)(i) of the Prevention of Food Adulteration Act, 1954.
2. Heard Ms.Jirga D.Jhaveri, learned advocate appearing on behalf of the applicant and perused the impugned judgment and order of acquittal and considering the same, it appears that the appeal deserves consideration. Hence, the present application is allowed and Leave to Appeal, as prayed for, is hereby granted.
