JUDGMENT / ORDER

1. Heard learned advocate, Mr.M.G.Nagarkar and learned advocate, Mr.Amit Shah for the respondent.
2. This appeal is preferred against the order dated 28-3-
2000 passed by the Court No.6, Small Causes Court, Ahmedabad, in Municipal Valuation Appeal No.1057 of 1998 by which the trial court has partly allowed the appeal and gross ratable value is reduced and fixed at Rs.28875/- for the year 1997-98.
3. Learned advocate, Mr.Shah submits that the respondent is the owner and occupier of property and hence, calculation was rightly made by the trial court relying upon a decision of this Court in the case of Rajnikant Jeshsing Shah Vs. Rameshchandra Kantilal Bhatt reported in 1982(1) GLR page 71 as well as the principles laid down in AIR 1994(Guj) page 167 in the case of The Ahmedabad Municipal Corporation Vs. The Oriental Fire and General Insurance Company Ltd.
4. In the opinion of this Court, valuation was correctly made by the trial court relying upon the decisions as referred hereinabove. Said order is just, legal and proper and no irregularity or perverseness is committed by the trial court in passing the said order. Hence, this appeal is dismissed.
