Court No. - 1
Case :- WRIT - C No. - 42401 of 2019 Petitioner :- Ahmad Ullah Respondent :- Union Of India And 5 Others Counsel for Petitioner :- Azizur Rahman Khan Counsel for Respondent :- A.S.G.I.,Vikas Budhwar
Hon'ble Ramesh Sinha,J. Hon'ble Ajit Kumar,J.
Heard Sri A.R. Khan, learned counsel appearing for the petitioner, Sri Vikas Budhwar, learned counsel appearing for the respondent Petroleum Corporation and perused the record.
By means of this writ petition, under Article 226 of the Constitution of India, the petitioner has assailed the order the order dated 23rd November, 2019 passed by respondent no.3 whereby the petitioner's candidature that has been rejected on 5th November, 2019 had come to be reiterated again and the ground assigned is that the petitioner who had earlier offered the land was not adequate as per the norms of the advertisement and the guidelines provided for that purpose and this time when the subsequent land has been offered by the petitioner, the same has been rejected on the ground that the petitioner did not have the sale deed of the land in question on the last date of the submission of the form, inasmuch as the petitioner did not come up with the offer of land in question in time when he had filed the application.
In such view of the matter, we are of the opinion that the petitioner did not possess the land by virtue of a lease deed or sale on the date of submission of form as to fall under Group-1 category. Thus, we do not find any manifest error in the order dated 23rd November, 2019 passed by authority of the Corporation-respondent no.3.
The writ petition fails and is, accordingly, dismissed.
