This petition for writ is preferred to have an appropriate writ, order or direction for respondent no. 2 to consider the application of petitioner for issuing passport.
It is submitted that the application of the petitioner has not been considered in correct perspective merely on the count that petitioner is facing trial for two incidents relating to minor offences. It is further brought to our notice that as per the Government of India notification dated 25.8.1993 the petitioner is eligible and does not suffer from any impediment for issuing a passport. Reliance is also placed by learned counsel upon a Division Bench judgment of this Court in Writ Petition (M.B.) No. 31723 of 2018 (Salim Khan Vs. Union of India and others).
Having considered the facts of the case and also the law laid down by a Division Bench of this Court in the case of Salim Khan (supra), we deem it appropriate to dispose of this petition for writ by directing the Regional Passport Officer, Bareilly to consider and decide the application submitted by the petitioner at earliest by keeping in mind the law laid down by this Court and also the intent of the notification dated 25.8.1993. The application is required to be decided by the respondent no. 2 within a period of four weeks from today.
This order has been passed in presence of Sri Tej Prakash, learned counsel appearing for respondent nos. 1 and 2.
