By order dated 08.10.2014 in Writ-B No. 52350 of 2014, this Court disposed of the writ petition by observing that order passed in mutation proceedings under Section 34 of the U.P. Land Revenue Act, 1901 could be examined in title proceedings before the Consolidation Authorities. There is also an observation to the effect that the decision would be taken by the Consolidation Authority without being influenced by the order passed in mutation proceedings.
The applicant has approached this Court in contempt proceedings alleging that the application filed by him for impleadment has been rejected by Consolidation Officer.
There is no direction by the Writ Court to allow the impleadment application of the applicant. The applicant could raise an independent title dispute himself. As such, it cannot be said that the order passed by the Consolidation Officer amounts to violation of the direction issued by the Writ Court.
However, in case the applicant feels aggrieved by the order passed by Consolidation Officer, it shall always be open to him to assail the same in appropriate proceedings.
The contempt application stands disposed of accordingly.
