JUDGMENT / ORDER

Petitioners, aggrieved by Ext.P1 stop memo issued by the Village Officer, have approached this Court. The Village Officer in Ext.P1 noted that the petitioners are reclaiming the land in contravention of the Act 28 of 2008. Petitioners submit that this property is not included in the draft data bank.
2. In that view, petitioners shall approach the Revenue Divisional Officer with relevant records. Petitioners can raise their objection before the Revenue Divisional Officer, Alappuzha. The Revenue Divisional Officer shall call for necessary report from the Agricultural officer. If the report indicates that their property is not included in the draft data bank as nilam or wet land, necessarily prohibition in Ext.P1 stop memo shall be lifted. However, if it is found that this property is not entered as wet land or paddy under Act 28 of 2008, the petitioners shall approach the Revenue Divisional Officer for permission to utilise the land in terms of clause (6) of the Kerala Land Utilisation Order, 1967 for other purposes.
W.P(C).No.27019 of 2014 B 2 If any request is made by the petitioners, that shall be considered in accordance with law. If the property is treated as nilam or wet land, the prohibition in Ext.P1 will continue to operate.
The Writ Petition is disposed of as above.
