The petitioner's vehicle, a JCB, bearing registration No.KL-54-A-2236 has been seized alleging transportation of ordinary earth in violation of the provisions under the Kerala Miner Mineral Concession Rules, 1967. The petitioner submits that his vehicle was only involved in leveling the land and it does not involved for transporting ordinary earth. Considering the facts and circumstances, there shall be a direction to the respondent to release the vehicle to the petitioner on executing a simple bond. However, this will not stand in the way of the respondent in proceeding against the petitioner, if so warranted, in accordance with law.
Writ petition is disposed of as above.
